A good deterrent to domestic assault is mandatory arrest and prosecution, even if the victim doesn't want to cooperate.

Too bad.

We arrest the abuser, jail him, prohibit him from returning home, and the D.A. prosecutes him without the victim's cooperation.

Once we instituted and enforced laws like this, I would go to domestic disturbances, and the first thing the guy would say to me was, "Hey, Officer. I didn't touch her because I don't want to go to jail." And ya know what? He really hadn't touched her.

I know of two people whose spouse made up claims of DV just to spite them or because they thought it might be helpful in any child custody battles. Whilst I agree with mandatory arrest (not mandatory jail), I also think penalties for false claims should also face tougher penalties.

In the U.S. a mere claim of abuse is not enough to arrest. There must be corroborating evidence, such as injuries, witnesses, etc. Parties to a divorce proceeding do often lie about each other in order to get custody of children, but that is different from a criminal charge. Mandatory arrest for Domestic Assault still requires all of the same probable cause and evidence as any other criminal charge. So if someone says "He hit me", there must be a provable injury as well before the police will arrest.

Decades ago the POLICE took out a DVO.. which was wrong to start with , should have been an AVO..on MY behalf , despite my opposition BUT it didn't mean diddly-squat. Not worth the paper it was written on.

He was never charged for any of the offences against me....

The named person continued to come to my place, both when I was at work, and at home. I'd see the tyre tracks... ..when I got home.

I rang the police.... was asked... any witnesses? .. UMM NO.. only me.

Oh well , nothing we can do.

Women are entitled to be believed... crooks that lie exist at every level of our society.

Especially the NSW Lib govt. Refuges for raped or abused women, staffed with workers experience/skills in this area had funding taken away and became just womens’ refuges, no specialised care. Bastards!
